This Privacy Policy explains how Fairy Glen (“Fairy Glen”, “we”, “us”, or “our”), located at 56, Spring Glen, Hatherly Road, Coonoor, Nilgiris, Tamil Nadu, India – 643101, collects, uses, shares, and protects your personal information.

It applies to your use of the website www.fairyglen.co.in and to any booking, stay, dining, or experience at Fairy Glen. It should be read together with our Terms & Conditions. By using our website or making a Booking, you (“Guest”, “you”) agree to the practices described here. 

We handle personal information in accordance with the Information Technology Act, 2000, the rules made under it, and the Digital Personal Data Protection Act, 2023, as applicable.

1. Information We Collect

We collect only the information needed to take your Booking, host your stay, and run our website, such as the booking person’s name, phone number, and email address.

  • Booking details: name, email address, phone number, postal address, stay dates, number of guests in your party, and any special requests.
  • Identity documents: a valid government-issued photo ID for each adult, collected at check-in as required under Indian law.
  • Payment information: we do not collect or store your payment details, such as card numbers, UPI IDs, or bank account details. All payments are processed directly by our payment partners.
  • Dining and experience preferences: dietary requirements and preferences you share so we can prepare meals and experiences.
  • Communications: emails, calls, messages, and feedback you send us.
  • Website usage data: IP address, browser and device type, pages visited, and how you reached our website, collected through cookies and similar technologies (see Section 5).

2. How We Use Your Information

We use your information to:

  • Process, confirm, and manage your Booking, including payments, cancellations, and refunds.
  • Verify the identity of adult guests at check-in and meet our legal reporting obligations.
  • Prepare dining and experiences in line with your stated preferences and dietary requirements.
  • Communicate with you about your Booking, stay, and any changes.
  • Respond to your enquiries, feedback, and complaints.
  • Improve our website, services, and guest experience.
  • Send you news and offers about Fairy Glen, only where you have agreed to receive them. You can opt out at any time.
  • Protect the safety and security of our guests, staff, and Property, and comply with applicable law.

3. Consent and Legal Basis

We process your personal information on the basis of your consent, given when you make a Booking, submit an enquiry, or use our website. We also process it where needed to fulfil your Booking or to comply with Indian law, such as guest identity verification.

You may withdraw your consent at any time by writing to us (see Section 14). Withdrawal does not affect processing already carried out. If you withdraw consent for information essential to a Booking, we may be unable to provide that Booking.

4. Sharing of Information

We do not sell or rent your personal information. We share it only as needed, with:

  • Payment partners such as banks, UPI providers, and payment gateways, to process your payments and refunds.
  • Booking platforms you use to reserve with us, to manage that Booking.
  • Service providers who support our operations, such as website hosting, email, analytics, and IT services. They may use your information only to provide those services to us.
  • Experience partners and local guides, only the details needed to arrange an experience you have booked.
  • Government and law-enforcement authorities, where required by law, including guest registration and ID verification requirements.
  • Professional advisers such as auditors and lawyers, where needed to protect our legal rights.

5. Cookies and Analytics

Our website uses cookies and similar technologies to keep it working properly, remember your preferences, and understand how visitors use it.

  • Essential cookies are needed for the website to function and cannot be switched off.
  • Analytics cookies, including Google Analytics, help us measure traffic and improve the website. This data is collected in aggregated form.
  • Marketing cookies, where used, help us show relevant Fairy Glen advertising on other websites.

Booking and payment records are retained for the period required under applicable tax and accounting laws. Once information is no longer needed, we delete it securely or anonymise it.

No method of transmission or storage is completely secure. If a personal data breach occurs, we will notify affected Guests and the relevant authorities as required by law.

8. Your Rights

Subject to applicable law, you have the right to:

  • Access a summary of the personal information we hold about you and how it is used.
  • Correct, complete, or update inaccurate or incomplete information.
  • Request erasure of your information, unless we must retain it by law.
  • Withdraw consent you have previously given.
  • Nominate another person to exercise these rights on your behalf in the event of death or incapacity.
  • Raise a grievance with us, and escalate it to the Data Protection Board of India if unresolved.

To exercise any of these rights, contact our Grievance Officer (see Section 11). We may need to verify your identity before acting on your request.

9. Children’s Information

Bookings must be made by a lead Guest aged 18 or over, as stated in our Terms & Conditions. We collect information about children in a party, such as their number and age, only from the lead Guest or a parent or guardian, and only to host their stay. We do not knowingly collect personal information directly from children through our website.

10. Third-Party Links

Our website may link to third-party websites, such as booking platforms, maps, or social media. We are not responsible for their privacy practices, and we encourage you to read their privacy policies.

11. Grievance Officer

In accordance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, you may contact our Grievance Officer with any concern about your personal information:

We will acknowledge your grievance and aim to resolve it within 30 days of receipt.

12. Governing Law & Jurisdiction

This Privacy Policy, and any matter arising out of or in connection with it, shall be governed by and construed in accordance with the laws of India. The competent courts in the Nilgiris District, Tamil Nadu, India, shall have exclusive jurisdiction over any dispute arising from or relating to this Policy.

We may update this Privacy Policy from time to time. The updated version will be published on this page with a revised “Last updated” date. Please review it periodically.
